The Spanish law firm Eskariam and the French firm Geradin Partners have announced the creation of a strategic alliance to pursue legal action on behalf of hotels affected by Booking.com's anti-competitive policies. This information was published on the website of the Spanish law firm Eskariam.
The cooperation is a response to a ruling by the EU Court of Justice on September 19, 2024, which declared the platform's “parity clauses” illegal, as they restricted hotels from setting their own prices freely.
The lawyers will coordinate lawsuits in Spain and France, with plans to expand to other EU countries, including Italy and Portugal.
Unlike the centralized process in the Netherlands, their approach relies on national judicial systems and offers adaptation to the legal and commercial realities of each country.
Eskariam is already handling large-scale lawsuits in Spain, including the “milk cartel” case, while Geradin Partners is active in antitrust proceedings across Europe, including cases against Google and Amazon. The alliance will strengthen the legal position of hotels and improve their chances of receiving compensation and promoting reform in the online booking market.
It also became known that the Council of the European Union approved an agreement with Canada on sharing Passenger Name Record (PNR) data to combat terrorism and international crime, emphasizing the importance of privacy standards.
